Section 1     Application


1.1     Title

1.1(1)   This Rule is Land Transport Rule: Dangerous Goods Amendment [2009].

1.1(2)   This Rule amends Land Transport Rule: Dangerous Goods 2005.


1.2     Date when Rule comes into force

This Rule comes into force on [date].


Section 2     Amendment of Rule requirements


2.1     NZ Standard 5433:2007

The Rule is amended by substituting the words “New Zealand Standard 5433:2007” for the words “New Zealand Standard 5433:1999” in:


2.2     Clause 1.5 Interpretation of Rule provisions

2.2(1)   Subclause 1.5(2) is amended by substituting “N.O.S.” for “NOS”.

2.2(2)   Paragraph 1.5(2)(b) is amended by inserting the words “until 31 December 2010” before the words “may be marked”.


2.3     Clause 2.2 Dangerous goods transported for hire or reward

2.3(1)   Clause 2.2 is amended by inserting the following paragraph and note:

“9.2(6)    Despite 9.2(1), a person who does not hold a current dangerous goods endorsement on their driver licence, may drive a vehicle or vehicle combination that is transporting dangerous goods if:
“(a)       the driver has an appropriate driver licence for the class of vehicle or vehicle combination they are driving; and

“(b)         the driver’s responsibilities for transporting dangerous goods are supervised by a person in the vehicle who holds a current dangerous goods endorsement on their driver licence.”

2.24     Clause 10.1 Responsibilities for general safety requirements

Paragraph 10.1(3)(a) is amended by substituting the words “, low risk biological products and dangerous goods in excepted quantities and excepted packages of radioactive material” for the words “and low risk biological products”.

2.25     Clause 10.4 Responsibilities of the driver of a road vehicle

Clause 10.4 is amended by inserting the following paragraph:

“(da) if 9.2(6) applies, the driver must ensure that the supervisor holds a current dangerous goods endorsement on their driver licence.”

2.26     Clause 10.7 Responsibilities of the supervisor

Section 10 is amended by inserting the following clause:

“Mixed loads The maximum quantity for a mixed load is an aggregate amount of 500, using the following units: kilograms (solids, powders, etc including the weight of the packaging), litres (liquids), litres water capacity (gases).

The quantity of Class 9 diesel, or Class 9 substances that are toxic to the aquatic environment, is in addition to the maximum quantity for a mixed load.

The maximum quantity for a mixed load is exceeded if the quantity for any class or division in the load exceeds the limit specified for that class or division.”

“* The maximum quantity is determined by the actual quantity of dangerous goods carried, measured in:

  • •   kilograms (including the weight of the packaging) for solids, powders, etc;
  • •   litres for liquids;
  • •   litres water capacity of the cylinder or container for gases, except for cryogenic liquids (such as UN 1977, NITROGEN, REFRIGERATED LIQUID) where the actual quantity can easily be measured with a dip-stick or similar measuring device.”

Part B     Tests for packaging for dangerous goods in excepted quantities

1     The complete package, as prepared for transport, must be able to withstand the tests in paragraphs 4 and 5 without any inner packaging breaking or leaking and without significant reduction in the effectiveness of the packaging.

2     The tests in paragraphs 4 and 5 may be carried out by any reasonable means and must be documented.

3     Inner packages must be prepared for the tests in paragraphs 4 and 5 as follows:

4     The complete package, as prepared for transport, must be dropped from a height of 1.8 m onto a rigid, non-resilient, flat and horizontal surface as follows:

5     The complete package, as prepared for transport, must have a force applied to its top surface for a period of 24 hours, equivalent to the weight of identical packages stacked to a height of 3 m, including the test package.
