Objective of the Rule

Land Transport Rule: Dangerous Goods Amendment 2010 amends Land Transport Rule: Dangerous Goods 2005 (the Dangerous Goods Rule), which sets out requirements for the safe transport of dangerous goods on land in New Zealand. The Dangerous Goods Rule covers the packaging, identification and documentation of dangerous goods, the segregation of incompatible goods, transport procedures and the training and responsibilities of those involved in the transport of dangerous goods.

The objective of the amendment Rule is to ensure that the risk to land transport safety from the transporting of dangerous goods within New Zealand continues to be effectively managed by maintaining alignment with international recommendations and local requirements relating to hazardous substances.

In seeking to meet its objective, the amendment Rule:


Extent of consultation

Formal consultation on the draft amendment Rule began in February 2009 when the NZ Transport Agency released the public consultation (yellow) draft of the Rule for comment. The NZ Transport Agency sent a letter or emailed advice about the availability of the yellow draft to about 690 groups and individuals who had registered their interest in the Dangerous Goods Rule. The availability of the draft amendment Rule was publicised in the metropolitan daily newspapers in Auckland, Hamilton, Wellington, Christchurch and Dunedin, and in the New Zealand Gazette.

The NZ Transport Agency received 19 submissions on the draft amendment Rule. The submissions were taken into account in redrafting the amendment Rule before it was submitted to Cabinet, and then signed by the Minister of Transport.

Part 1        Rule requirements

Section 1     Application

1.1     Title

1.1(1)     This Rule is Land Transport Rule: Dangerous Goods Amendment 2010.

1.1(2)     This Rule amends Land Transport Rule: Dangerous Goods 2005.

1.2     Date when Rule comes into force

This Rule comes into force on 1 April 2010.

Section 2     Amendment of Rule requirements

2.1     NZ Standard 5433:2007

The Rule is amended by substituting “New Zealand Standard 5433:2007” for “New Zealand Standard 5433:1999” in:

2.2     Clause 1.5 Interpretation of Rule provisions

2.2(1)     Subclause 1.5(2) is amended by substituting “N.O.S.” for “NOS”.

2.2(2)     Paragraph 1.5(2)(b) is amended by inserting “until 31 December 2010” before “may be marked”.
