By applying for a Clean Car rebate, you accept these terms together with the Waka Kotahi NZ Transport Agency website terms of use. These terms are between you and us (Waka Kotahi). If you apply for a Clean Car rebate on behalf of someone else, you are also accepting these terms on their behalf.
Waka Kotahi website terms of use
If you don’t want to be bound by these terms, you must not use the website to apply for a Clean Car rebate.
The New Zealand Transport Agency has the function of administering the clean vehicle discount scheme (Clean Car Discount) (as provided for under section 95(1)(ma) of the Land Transport Management Act 2003).
The Clean Car Discount is an initiative set up to reduce transport sector CO2 emissions.
Part of the Clean Car Discount includes the provision of rebates (Clean Car rebate) for eligible vehicles with lower carbon dioxide emissions. The Clean Car rebate is administered in accordance with the direction provided to Waka Kotahi, under section 103 of the Crown Entities Act 2004.
Eligible registered persons (and eligible persons who are not registered in limited circumstances) of eligible vehicles are able to apply for a Clean Car rebate as part of the Clear Car Discount scheme.
To apply for a Clean Car rebate, you (or if you are applying on behalf of another person, that person) must meet the eligibility criteria and provide us with the information requested through the application process. The 2021 Clean Car privacy policy will apply to all information we collect for the purpose of an application.
You may apply for the rebate on behalf of another person, so long as they:
If you do apply for someone else, you agree that you have their authority to agree to these terms on their behalf.
We will endeavour to process applications as soon as reasonably possible from our receipt, so long as you’ve complied with these terms (e.g., by providing accurate and complete information). Once your application has finished being assessed, we’ll contact you via the supplied email address on the application form to let you know whether or not your application has been approved. If your application is approved, we will pay the rebate to the bank account stated in your application, subject to these terms.

Only persons that meet the eligibility criteria (at the time when the application is made) are eligible for a Clean Car rebate. Please note that the eligibility criteria may change from time to time, with or without notice to you, including as a result of Cabinet decisions or changes via a direction to Waka Kotahi under section 103 of the Crown Entities Act 2004.

By applying for a Clean Car rebate via the website, you agree that you are aware of the eligibility criteria and that you believe on reasonable grounds that you (or the person on whose behalf you are applying) meet the eligibility criteria.
If the eligibility criteria changes at any time, we will update our information on the website to reflect these changes.
Please note that the amount available under the Clean Car rebate may vary between applicants, even where an application is made in relation to the same make and model of vehicle (for example, because of differences in the registered person’s GST status, the date the vehicle was first registered in New Zealand, or the CO2 emissions of that vehicle calculated in accordance with the Land Transport Rule: Vehicle Efficiency and Emissions Data 2022).
Please be aware that for the purposes of calculating a rebate, the carbon dioxide emissions of the vehicle is as calculated in accordance with the Land Transport Rule: Vehicle Efficiency and Emissions Data 2022 (see clause 3.5 of that Rule).
Without limiting any of your other obligations under these terms or the Waka Kotahi website terms of use, you agree that when you apply for the Clean Car Rebate, and in all your related dealings with us, you will:

You must provide Waka Kotahi with any documents or information reasonably requested by Waka Kotahi for the purpose of assessing whether you (or the person on whose behalf you have made the application) meet the eligibility criteria and/or these terms.
I understand that Waka Kotahi will seek information from the Registrar of Motor Vehicles to find out if the information I have provided matches what is held on the Motor Vehicle Register. If my personal or motor vehicle information on the Motor Vehicle Register has confidential status, I request access to it in accordance with Information Privacy Principle 6 of the Privacy Act 2020 and appoint Waka Kotahi as my representative to receive that information for the purposes of processing this application.

You, or the person on whose behalf you have made this application, must provide Waka Kotahi with any documents or information reasonably requested by Waka Kotahi for the purpose of carrying out an audit in relation to a Clean Car rebate you (or a person on whose behalf you have made the application) have received (if the application for a Clean Car Rebate was successful). This information may be requested in order to satisfy Waka Kotahi that you (or the person on whose behalf you have made the application) were eligible to receive the Clean Car rebate, and future requirements that had to be complied with under the eligibility criteria were complied with.
If you, or the person on whose behalf you have made this application, fail to provide any information requested in accordance with the above, we may require that Clean Car rebate to be repaid, in whole or in part. You, or the person on whose behalf you have made the application, must promptly pay that amount to us on request.
Where you make an application and the person described in the application receives a Clean Car rebate that they weren’t entitled to (or an amount over and above the applicable Clean Car rebate they were entitled to), you, or the person on whose behalf you have made the application, must ensure that amount is promptly paid to us on request.
To the maximum extent permitted by law, we will not be liable to you (or a person on whose behalf you have applied for a Clean Car rebate) for any loss to you or others caused by:
We may change these terms from time to time by publishing an updated version of the terms on the website. The updated terms will be effective from the time they are published.
If at any time we don’t enforce a provision of these terms or give you extra time or other leeway to comply, this doesn’t mean that we have waived that provision or given up our rights to enforce that provision, or any other provision.
If a provision of these terms is found to be invalid, unenforceable or in conflict with the law, that part is replaced with a provision which, as far as legally possible, accomplishes the original purpose of that part. The remaining terms will continue to be binding.
Unless we give written consent, you must not assign your rights or delegate your obligations under these terms.
These terms are governed by New Zealand law, and you and we agree to the non-exclusive jurisdiction of the New Zealand courts in relation to all disputes arising out of or in connection with these terms.
Unless the context requires otherwise, in these terms:
