2021 Clean Car rebate terms and conditions

1. Agreement to terms

By applying for a Clean Car rebate, you accept these terms together with the Waka Kotahi NZ Transport Agency website terms of use. These terms are between you and us (Waka Kotahi). If you apply for a Clean Car rebate on behalf of someone else, you are also accepting these terms on their behalf.

If you don’t want to be bound by these terms, you must not use the website to apply for a Clean Car rebate.

2. What is the Clean Car Discount scheme?

The Clean Car Discount scheme is an initiative set up under a Cabinet decision to reduce transport sector CO2 emissions. It entitles eligible registered persons (and persons who are not registered in limited circumstances) of eligible vehicles to apply for a Clean Car rebate. Waka Kotahi was directed by the Minister of Transport on 20 June 2021 to undertake any functions for administering the Clean Car Discount scheme.

These terms apply specifically to the initial Clean Car rebate, which applies to eligible vehicles first registered in New Zealand between 1 July 2021 and 31 December 2021. A similar scheme is likely to be set up under legislation and apply to eligible vehicles registered in New Zealand from 2022 onwards, but it may have different requirements and function in a different way to the Clean Car rebate available under these terms.

3. How does the application process work?

To apply for a Clean Car rebate you (or if you are applying on behalf of another person, that person) must meet the eligibility criteria and provide us with the information requested through the application process. The 2021 Clean Car privacy policy will apply to all information we collect for the purpose of an application.

You can apply for a Clean Car rebate under these terms up until 28 February 2022, so long as the relevant vehicle was first registered in New Zealand between 1 July 2021 and 31 December 2021. We don’t have to process any applications received after this time (but as set out in clause 2, a different scheme may be implemented for eligible vehicles registered in New Zealand from 2022 onwards).

You may apply for the rebate on behalf of another person, so long as they are a registered person (or, if they are not the registered person, they come within the exception set out in the eligibility criteria) for a relevant vehicle that meets the eligibility criteria and they’ve given their consent (see below at clause 5). If you do apply for someone else, you agree that you have their authority to agree to these terms on their behalf.

We will endeavour to process applications as soon as reasonably possible from our receipt, so long as you’ve complied with these terms (eg, by providing accurate and complete information). Once your application has finished being assessed, we’ll contact you via the supplied email address on the application form to let you know whether or not your application has been approved. If your application is approved we will pay the rebate to the bank account stated in your application, subject to these terms.

However, we aren’t required to pay out a Clean Car rebate if you don’t provide us with all information that we reasonably need in order to assess your application, or if you don’t meet the eligibility criteria. We also won’t pay out a Clean Car rebate if we are required by law not to pay it, if the money allocated to fund the Clean Car rebate is expended before we approve your application, or to the extent the Government ends the Clean Car Discount scheme or changes it in a way that excludes you (or the person on whose behalf you are applying) from access to the Clean Car rebate before we approve your application.

4. How does eligibility work?

Only vehicles that meet the eligibility criteria (at the time when the application is made) are eligible for a Clean Car rebate. Please note that the eligibility criteria may change from time to time, with or without notice to you, including as a result in changes in Government policy.

By applying for a Clean Car rebate via the website, you agree that you are aware of the eligibility criteria and that you believe on reasonable grounds that you (or the person on whose behalf you are applying) meet the eligibility criteria.

If the eligibility criteria changes at any time, we will update our information on the website to reflect these changes within a reasonable time.

Please note that the amount available under the Clean Car rebate may vary between applicants even where an application is made in relation to the same make and model of vehicle (for example, because of differences in the registered person’s GST status).

5. What are my obligations?

Without limiting any of your other obligations under these terms or the Waka Kotahi website terms of use, you agree that when you apply for the rebate, and in all your related dealings with us, you will:

  • ensure that the information you provide us is accurate, complete, up-to-date, and not false or misleading,
  • ensure that you have all rights necessary to provide all of the information that you provide us in relation to the application, and
  • if you make the application on behalf of a another person, ensure you have their consent to do so, that they understand that the Clean Car Privacy Policy will apply to their personal information provided in the application, and that you have all authorisations from them needed for us to collect, use and disclose their personal information as set out in the Clean Car Privacy Policy.

6. What information must I provide?

You must provide Waka Kotahi with any documents or information reasonably requested by Waka Kotahi for the purpose of assessing whether you (or the person on whose behalf you have made the application) meet the eligibility criteria and/or these terms.

I understand that Waka Kotahi will seek information from the Registrar of Motor Vehicles to find out if the information I have provided matches what is held on the Motor Vehicle Register.  If my personal or motor vehicle information on the Motor Vehicle Register has confidential status, I request access to it in accordance with Information Privacy Principle 6  of the Privacy Act 2020 and appoint Waka Kotahi as my representative to receive that information for the purposes of processing this application.

7. Do I have obligations to provide Waka Kotahi with information after I receive a rebate?

You must provide Waka Kotahi with any documents or information reasonably requested by Waka Kotahi for the purpose of carrying out an audit in relation to a rebate you (or a person on whose behalf you have made the application) have received (if the application for a rebate was successful). This information may be requested in order to satisfy Waka Kotahi that you (or the person on whose behalf you have made the application) were eligible to receive the rebate, and future requirements that had to be complied with under the eligibility criteria were complied with.

If you fail to provide any information requested in accordance with the above, we may require that rebate to be repaid, in whole or in part. You must promptly pay that amount to us on request, or ensure that the person on whose behalf you have made the application promptly pays that amount.

8. What happens if there is an error?

Where you make an application and the person described in the application receives a Clean Car rebate that they weren’t entitled to (or an amount over and above the applicable rebate they were entitled to), you must ensure that the person promptly pays those amounts to us on request.

9. Our liability to you

To the maximum extent permitted by law, we will not be liable to you (or a person on whose behalf you have applied for a rebate) for any loss to you or others caused by:

  1. the inability to access or use the website to submit an application;
  2. for any failure or delay in assessing an application;
  3. for any error in assessing an application which results in you (or the person on whose behalf you have applied) being required to repay an overpayment of the Clean Car rebate; or
  4. any error or delay on our part in any processing or payments relating to your application (including in circumstances where the application is processed after funding for the Clean Car rebate has been expended).

10. How can we change these terms?

We may change these terms from time to time by publishing an updated version of the terms on the website. The updated terms will be effective from the time they are published.

11. Other matters

If at any time we don’t enforce a provision of these terms, or give you extra time or other leeway to comply, this doesn’t mean that we have waived that provision or given up our rights to enforce that provision, or any other provision.

If a provision of these terms is found to be invalid, unenforceable or in conflict with the law, that part is replaced with a provision which, as far as legally possible, accomplishes the original purpose of that part. The remaining terms will continue to be binding.

Unless we give written consent, you must not assign your rights or delegate your obligations under these terms.

These terms are governed by New Zealand law, and you and we agree to the non-exclusive jurisdiction of the New Zealand courts in relation to all disputes arising out of or in connection with these terms.

12. What do the words in these terms mean?

Unless the context requires otherwise, in these terms:

  1. “application” means an application for a Clean Car rebate,
  2. “Clean Car rebate” means the rebate contemplated by Cabinet on 19 April 2021 or any subsequent decisions of the Cabinet,
  3. “eligibility criteria” means the criteria that must be satisfied for a person to be eligible to receive a rebate, as set out in the eligibility criteria on Waka Kotahi’s website,
  4. “registered person” means the person registered in relation to the relevant vehicle under Part 17 of the Land Transport Act 1998,
  5. “relevant vehicle” means the vehicle in relation to which the rebate is being applied for,
  6. “these terms” means these Clean Car Scheme Terms and Conditions,
  7. “we”, “us”, and “our” are references to Waka Kotahi NZ Transport Agency,
  8. “website” means the website found at nzta.govt.nz (or any replacement website), and
  9. "you" and "your" are references to the person using the website.
