From time to time, suppliers may approach the NZ Transport Agency with a proposal to meet a perceived need, without being asked to do so. This is called a market-led proposal (also known as an unsolicited proposal), and is defined by the Treasury as:

....where a Proponent wishes to deal directly with Government with a proposal, where the Government has not requested the proposal.

The Proponent’s (ie supplier’s) proposal may be a commercial proposition, project, or developed concept to build infrastructure, provide goods or services, or undertake a major commercial transaction.

In mid-2024, the Government commissioned the Treasury to undertake a review of the existing guidelines for market-led proposals, leading to an approved release of these new guidelines.

A key change under the new guidelines is that all market-led proposals must be submitted directly to the Government’s infrastructure agency National Infrastructure Funding and Financing (NIFF). Submissions must be made by Proponents and can’t be made by government agencies on behalf of Proponents.
